PD That Works LLC ("PDTW," "we," "us," "our") provides professional-development kits, follow-up tooling, and AI coaching for educators, at pdthatworks.com and app.pdthatworks.com. Questions: hello@pdthatworks.com.
PDTW is for educators and school staff. You must be able to form a binding contract. If you create an individual teacher account, you agree to these terms for yourself only — you do not bind your school. If you accept on behalf of a school or organization, you represent that you are authorized to bind it, and school purchases are also governed by a signed agreement (see School & District Terms). PDTW is not intended for use by anyone under 18.
Keep your sign-in secure and don't share your credentials. You're responsible for activity under your account. Tell us promptly at hello@pdthatworks.com if you suspect unauthorized use. Sign-in uses emailed one-time codes/links.
A kit purchase grants the purchasing school a perpetual, non-exclusive license to use, edit, and print the materials for its own sessions. The detailed license accompanies each kit and controls. You may not resell, redistribute, or publicly post the materials, or remove copyright or attribution.
60-day satisfaction guarantee: if a kit isn't valuable for your school, contact us within 60 days of purchase for a full refund.
The kit materials, frameworks, and designs are the intellectual property of PD That Works LLC. Third-party media referenced in kits belongs to its owners and is linked, not redistributed.
A teacher trial requires no payment method and does not convert to a paid plan automatically. When the trial ends, you are not charged, and you keep the ability to read, export, and delete your data. Starting a paid subscription is always a separate, deliberate choice.
The Quarterly Cycle is a one-time purchase that provides 90 days of access. It does not auto-renew and does not create a recurring subscription. You may request a full refund within 14 calendar days of purchase; after that, the purchase is non-cancelable and access ends at the close of the stated term.
The coach is AI, not a human, and its output can be inaccurate. It is guidance for reflection — not professional, clinical, legal, or emergency advice — and you should apply your own judgment. Any AI-drafted message an administrator sends is reviewed and sent by a human. AI outputs and private content must not be used for discipline, evaluation, promotion, compensation, termination, or other consequential employment decisions. How AI processing works is described in our Privacy Notice.
A teacher's private coaching work — reflections, goals, conversations, and private reports ("Private Teacher Content") — belongs to the teacher. You grant PDTW a narrow, non-exclusive license to process that content only to provide and improve the coaching service to you. School-facing aggregate reports belong to the school. The teacher privacy floor — that a school cannot read Private Teacher Content — is part of these terms.
Teachers can export their own writing from within the product. If a school's sponsorship ends, the teacher's portable account and history remain with the teacher (subject to any student-data rules). You can request deletion as described in the Privacy Notice.
We may suspend or terminate access for violation of these terms or misuse of the service. You may stop using PDTW at any time and cancel any subscription as described above. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, and limitations) survive.
PDTW is provided on an "as is" and "as available" basis. We use reasonable efforts to keep it available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we do not warrant that the AI coach's output is accurate, complete, or appropriate for any specific situation — it is guidance to think with, and you remain responsible for your professional judgment. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
To the extent permitted by law, PDTW is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising out of or relating to your use of the service. Nothing in these terms limits or excludes any right or remedy that cannot be waived or limited under applicable law, and nothing here limits liability for fraud, willful misconduct, or gross negligence.
Aggregate Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PDTW'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, REGARDLESS OF THE FORM OR THEORY OF THE CLAIM, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PDTW FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). THE LIMITATIONS IN THIS SECTION APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. NOTHING IN THIS SECTION LIMITS LIABILITY TO THE EXTENT IT CANNOT LAWFULLY BE LIMITED. IF YOU AND PDTW HAVE ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT EXPRESSLY PROVIDES A DIFFERENT LIABILITY LIMIT, THAT AGREEMENT CONTROLS.
These terms carry a version and an effective date. If we make a material change, we will provide notice through the product or by email and, where appropriate, ask you to re-accept before the change applies to you. Continued use alone is not the only way changes take effect.
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules — except where the law of your own jurisdiction applies and cannot be overridden by agreement. Purchases by schools and districts are additionally governed by the signed school agreement, which controls over this section where the two conflict, including any terms a public entity is required by law to include.
